Jurisdictional Notice

Depending on your place of residence or habitual location, different legal entities are responsible for providing crypto-asset services via the Platform, as set out below.

(a) Users Located in Canada (“Canadian Users”)

Crypto-asset services made available via the Platform to users located in Canada are provided by Clearcrest UAB, legal entity code 306094970, with its registered office at Lvivo g. 21A, LT-09313 Vilnius, Republic of Lithuania (“Clearcrest”).

Clearcrest is registered as a Money Services Business (MSB) in Canada under registration number M23928203 and, on this basis, currently provides crypto-asset-related services to clients located in Canada, subject at all times to applicable Canadian laws and regulatory requirements, including those administered by FINTRAC.

For the avoidance of doubt, from 1 January 2026, Clearcrest will no longer provide crypto-asset services within the European Union and it is not regulated or supervised by the Bank of Lithuania.

(b) Users Located in the Rest of the World, Including the European Union (“ROW Users”)

Crypto-asset services made available via the Platform to users located outside Canada, including users located within the European Union, are provided exclusively by Monteris sp. z o.o., a company incorporated under the laws of the Republic of Poland, entered in the National Court Register (KRS) under number 0001101442, with its registered office at Hoża Street No. 86, Unit 210, 00-682 Warsaw, Poland (the “Monteris”).

Monteris sp. z o.o. is registered in the Register of Virtual Currency Business Activity (RDWW) under registration number RDWW-1285, and provides services in accordance with applicable Polish law and any applicable transitional or supervisory framework.

User Classification and Access Restrictions

We may determine whether you qualify as a Canadian User or a ROW User based on information provided by you and/or reasonably available technical indicators, including, without limitation, IP address, geolocation data, and the country of issuance of payment instruments.

We reserve the right, at any time and at our sole discretion, to:

• restrict, suspend, or block access to certain features of the Platform where such features are not offered or permitted by the relevant service-providing entity; and/or
• redirect you to the appropriate legal entity responsible for providing services applicable to your jurisdiction.

You must promptly notify us of any change to your residence or habitual location that may affect your eligibility to access services via the Platform.
